Mediation & Arbitration
Attorney Alan Swanson has vast experience serving as mediator and arbitrator in a wide variety of disputes throughout Olympia and Thurston County. Mediation is a formal settlement conference. Typically the parties briefly meet together with the mediator and thereafter go into separate rooms with their own attorneys (if any), and the mediator shuttles between the rooms in an attempt to broker an accord. However, the mediator does not have the authority to decide any contested matters and the parties may opt to discontinue the mediation at any time if settlement does not appear likely. Arbitration, on the other hand, is like an in-formal trial. All parties present their evidence in the form of testimony before the arbitrator, and thereafter, the arbitrator issues a binding award that may or may not be appealed. Mr. Swanson is available to serve as mediator or arbitrator in the following types of cases: real estate, personal injury, business, contracts and probate. If you have a contract that requires mediation or arbitration or if you are involved a dispute where you and your opposing party agree to submit the matter to mediation or arbitration, Mr. Swanson is available to serve as your neutral, third-party facilitator.
